It’s been awhile since our last update and there’s been a lot happening on the Immigration scene since then. Here’s a recap of the events of the last couple of months.

POLICY UPDATES

  • Final Selection of Skilled Migrant Expressions of Interest (current policy)
    The final selection of Expressions of Interests under current policy will happen on 16 August 2023. You’ll have until 11:59pm 15 August 2023 to submit your Expression of Interest based on the current 180 point criteria.  

     

  • Changes to the Skilled Migrant Category Resident Visa
    A new simplified points system will be introduced for the Skilled Migrant Category (SMC) Resident Visa on 9 October 2023.

    The new approach aims to provide a faster route to residence for people in high skilled roles and others will have a clear route to residence if they work for a period in Aotearoa New Zealand.

    Under the new system, all SMC applicants must have a job offer for, or current employment in, a role paid at least:

    • the median wage for occupations classified at ANZSCO skill level 1-3, or

    • 1.5 times the median wage for occupations classified at ANZSCO skill level 4-5.

       

    In addition, they need six points to apply. This can be made up from:

    • three to six points based on New Zealand occupational registration, or a recognised qualification or income; and

    • one point per year of work in a New Zealand skilled job, up to a maximum of three points.


    The age limit, English language, health, and character requirements for residence applications remain unchanged.

     

  • Visa Transfers now available online
    Paper applications are no longer necessary to process visa transfers from your old passport to your new one.

     

  • New Transport Sector Work to Residence categories available
    Persons with roles as bus drivers, truck drivers, ships masters and deck hands may now qualify for Transport Sector Work to Residence visas.

  • Changes to Partner of a Work Work Visa Settings
    From 31 May 2023, many partners of workers who hold an Accredited Employer Work Visa (AEWV) or an Essential Skills Work Visa (ESWV) will need to work for an Accredited Employer and be paid at least the median wage, or if working in a role covered by an uncapped Sector Agreement, they must be paid at least the relevant wage threshold.

    These conditions will need to be met at the time the employer provides the offer of employment, or for those who are already employed, from the start date of the work visa (whichever is the latest). Any subsequent changes to the employer’s accreditation, the median wage and sector agreements will not impact the visa holder for the duration of the visa if they remain in the same employment.

     

  • Extension to Accreditation for Employers
    The initial accreditation periods for the Accredited Employer Work Visa (AEWV) will be automatically extended by 12 months if employers apply before 4 July 2023.

  • Accreditation extension implemented to support AEWV employers
    Last year, the Government decided to extend the initial accreditation period for Accredited Employer Work Visa (AEWV) to give employers more certainty while they get used to the accreditation system.

    Employers who are currently accredited do not need to do anything. Your accreditation will be extended and will be valid for 24 months from their approval date.

    You should receive notification when the expiry date for your current accreditation certificate is updated to the new expiry date in the enhanced Immigration Online system. All currently accredited employer’s details should be updated by 2 June 2023

We’re a little late this month, but here’s a look back at what’s been happening in the Immigration scene over the last month and a half.

POLICY UPDATES

  • Median Wage increase
    On 27/02/2023, the median wage to employee migrants increased to $29.66 for the Accredited Work Visa and other schemes that use wage thresholds.

  • Specific Work Purpose Recovery Visa
    In the wake of Cyclone Gabriel, the Government has announced the launch of the Recovery Visa (a Specific Purpose Work Visa). This short-term visa will allow employers to sponsor migrants to come to New Zealand to work on the emergency response.

  • Visa access for family violence victims
    Applications for the Victims of Family Violence Work Visa from people who hold a partnership-base visa with another temporary migrant can be made from 28 February 2023. This visa has a 6-month duration and open work rights. There is no fee for this visa. It is granted independently and does not depend on the applicant’s partnership.

  • Partner work rights changes under the Immigration Rebalance
    From 31 May 2023, partners of most Accredited Employer Work Visa (AEWV) and Essential Skills Work Visa (ESWV) holders granted a partnership-based work visa must:
    • work for an Accredited Employer and
    • be paid at least the median wage or the wage threshold if the role is covered by an un-capped sector agreement.

  • 2022 Special Ukraine Visa
    The government is making changes to the 2022 Special Ukraine Visa to support New Zealand’s Ukrainian community.
    • Extending Expressions of Interest till15/03/2024
    • Extending the time to travel to NZ to 12 months from March 2023
    • INZ are changing the way sponsorship works for the 2022 Special Ukraine Visa. Each application must have a nominating family member who meets the New Zealand and Ukrainian residency requirements and an acceptable sponsor or entity who would take on financial responsibility for the applicant. The nominating family member and sponsor can be the same person.

  • Extension to Accreditation for Employers
    The initial accreditation periods for the Accredited Employer Work Visa (AEWV) will be automatically extended by 12 months if employers apply before 4 July 2023.

  • New Zealand Working Holiday visa changes for UK travellers
    The United Kingdom and New Zealand have agreed to the following reciprocal improvements:
    • Extending the eligible age range to 18 – 35 years.
    • Extending the length of stay allowed to three years.
    • An extension to the length of time visa holders can work to three years.
    • New Zealand will introduce an annual cap of 15,000 places for UK nationals applying
      under the WHS (there is currently no cap for the UK WHS).

Immigration News

  • Nurses & Midwives – Straight to Residence
    From 15 December 2022, registered nurses and midwives will move from the Work to Residence to the Straight to Residence Green List pathway. All medical doctors will also be included on the Straight to Residence pathway. From March 2023, auditors will also be added to the Straight to Residence Green List pathway

  • 10 New Professions added to Green List
    Ten new professions will be added to the Work to Residence Green List pathway from March 2023, including primary and secondary school teachers.

  • Open Work Visas
    An Open Work Visa will be available for people who were unable to use Post Study Visas in 2020 – 2021.

  • Employer Accreditation Automatic Extensions
    Employer accreditations under the Accredited Employer Work Visa will automatically be extended by 12 months if their first accreditation is applied for by 4 July 2023.

  • Bus & Truck Drivers Limited Residence Pathway
    Bus and truck drivers will have a time limited residence pathway through a sector agreement.

  • Changes to work rights for partners deferred to April 2023
    The Minister of Immigration announced that planned changes for the visa requirements of partners of temporary work visa holders have been deferred to April 2023.

Here’s an update on what’s happened with Immigration New Zealand in last month.

  • Spain Working Holiday Scheme Reopens
    The Spain Working Holiday Scheme reopened on 29/11/200 with an additional 200 places available

  • Update on 2021 Resident Visa prioritisation
    INZ has extended the processing time for the 2021 RV from 12 to 18 months, but for persons who have family members included in their applications an escalation process now exists to try to speed up those applications. This however can only be done if the application is at the “Under Assessment” phase.

  • Update on Parent & Grandparent Visitor VIsa’s
    For applications received between 01/08/22 and 21/09/22 INZ are implementing a one-off change to persons who were affected by issues with the Immigration Online Platform.
    INZ requests for medicals meant applications did not progress and so they will now proceed to process these applications as General Visitor VIsa’s with similar conditions as the Parent/Grandparent visa. INZ will be in touch if you fall into this category

  • Skilled Migrant Category Resident Visa – Expressions of interest selections resume
    EOI selection was delayed until 11/11/2022 due to increased demand.

Here’s an update on what’s happened with Immigration New Zealand in last month.

  • Nursing or healthcare professionals who want to work in New Zealand can apply for specific work visas but must meet requirements for nursing registration and the Competence Assessment Programme and the CAP fund.

    if you are an Internationally Qualified Nurse (IQN) nurse and need to complete a Competence Assessment Programme (CAP), you can apply for an Occupational Registration Visitor Visa


  • FIFA Womens World Cup
    Changes have been made to immigration instructions to allow people participating in the FIFA Women’s World Cup 2023 to undertake work related to the tournament while holding a visitor visa. This includes people from visa waiver countries who hold NZeTAs.


  • Medical Certificate Issues
    Immigration New Zealand (INZ) are aware of some customers are experiencing difficulties at the medical phase of the application process, when applying for a Visitor Visa, a 2021 Resident Visa, or an Accredited Employer Work Visa using Immigration Online. INZ apologise for the confusion this status is causing and are working to improve the information we provide customers as their application is progressed.

  • Parent Resident Visa restarts
    The Parent Resident Visa restarts on 12 October 2022 with reduced requirements for sponsors. INZ resume selecting existing expressions of interest (EOIs) on 14 November 2022. INZ are increasing the number of visas available each year from 1000 to 2500.

  • Skilled Migrant Category Resident Visa – Expressions of interest selections resume
    On 9 November Immigration New Zealand will select all EOIs at the current threshold of 160 points. After 9 November, the points threshold for selection will increase to 180 points, to better align with the future direction of the Skilled Migrant Category. EOIs will be selected again on 18 January 2023.

  • New Median Wage from February 2023
    The new median wage of NZD $29.66 an hour will be adopted into the immigration system on 27 February 2023.

  • Green list and Employer Assisted Work Visas (AEWV)

    Extension of the medical registration requirements to include ‘special purpose locum tenens scope of practice’


  • Chefs under AEWV

    Chefs are no longer required to have a certificate at NZQF Level 4 or higher, which includes the credit and knowledge requirements of a New Zealand Certificate in Cookery (Level 4), or comparable overseas qualification.


  • The new Active Investor Plus visa category opened for applications on Monday 19 September 2022. 
  • Changes to the Acceptable Standard of Health cost threshold came into effect on 04 September 2022.
    The threshold increased to NZD$81,000.00
  • INZ will open registrations for the Samoan Quota from 03 October to 04 November 2022.
    Quota is set at 1,100 paces
  • INZ will open registrations for the Pacific Access Quota on 05 October to 04 November 2022
    Quota places are set as follows: Fiji 250, Tonga 250, Tuvalu 75 and Kiribati 75 
  • Working Holiday Schemes caps have increased as a one off from September 2022
  • Minister of Immigration Michael Wood announced an increase to the Recognised Seasonal Employer (RSE) cap, which will be set at 19,000 for the 2022/23 year.
  • Changes to the Post Study Work visa eligibility rules came into effect on 29 August 2022.

  • Green list updated with several medical roles and a trade (electrician’s) role
  • All 2021 Resident Visa (21RV) Category immigration instructions have been revoked as the category closed on 31 July 2022.
